In a case involving the encroachment of a storm water drain (SWD) by SV Elegant, an apartment in Kumbena Agrahara in East Bengaluru, the civic body Bruhat Bengaluru Mahanagara Palike (BBMP) told National Green Tribunal (NGT) on March 8 that a wire-mesh fencing could be allowed on the buffer zone of the drain to protect the apartment’s boundary.
Earlier, the apartment had constructed a boundary wall, bathroom and swimming pool in the buffer zone of the SWD. Following a complaint by V Paramesh, an activist, the NGT’s southern zone bench took ip a case last year against the apartment. The builder, on March 2, submitted an affidavit to the NGT that the compound wall on the buffer zone would be demolished but requested if they could be permitted to use an eco-friendly mesh to protect the apartment’s boundary. .
“We further submit that since the compound wall inadvertently erected earlier in buffer area is now being removed, in order to prevent intruders from illegal entry to the buffer zone and further to prevent the saplings being grazed by the herds, we humbly request this Hon’ble Tribunal to permit us to put up an eco- friendly mesh at the edge of aforesaid buffer area of our property for the said bonafide purposes,” the affidavit filed by the apartment read.
BBMP informed NGT wire mesh fencing is permitted to be erected in the buffer zone.
Acrylic Noise Barrier Board “Accordingly, the undertaking given in the affidavit is taken on record and the Project Proponent is strictly instructed to erect the wire mesh fencing retaining the buffer zone which they have agreed to use only for growing saplings and for plantation purposes. The Karnataka State Pollution Control Board is directed to inspect the property and impose environmental compensation,” NGT said in the order.
